Terms of Service

1. Service provider

Foplink is provided by Netinteractive sp. z o.o., with its registered office at ul. Saska 103/1, 03-914 Warsaw, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS 0000612484, NIP 5272766291, VAT ID PL5272766291, REGON 364134276 (the “Provider”, “we”, “us”).

2. The service

Foplink enables users to create website review projects, invite reviewers, attach comments to page elements, manage discussions and statuses, and export feedback. Some functionality may require a Foplink account or the Foplink Reviews Chrome extension.

We may improve, update, or discontinue individual features. Where a material change adversely affects an active paid service, we will provide reasonable notice where practicable.

3. Accounts and authorized use

You must provide accurate account information, keep access credentials confidential, and promptly notify us of suspected unauthorized access. An organization is responsible for activity performed through accounts and invitations it controls.

You may use Foplink only for lawful website review and collaboration. You must not interfere with the service, attempt unauthorized access, upload malware, infringe third-party rights, unlawfully process personal data, or use the service to distribute abusive or illegal content.

4. Customer content and permissions

You retain rights in files, URLs, comments, annotations, and other content submitted to Foplink. You grant us a non-exclusive permission to host, copy, process, display, and transmit that content only as needed to provide, secure, maintain, and support the service.

You confirm that you have the rights and lawful basis needed to submit the content and invite reviewers. Do not submit confidential, personal, or production data that is not necessary for a review.

5. Availability and support

We aim to keep Foplink available and reliable, but uninterrupted or error-free operation is not guaranteed. Access may be limited for maintenance, security, legal compliance, or events outside our reasonable control. Support requests can be submitted through the Support page.

6. Fees and taxes

If paid plans are offered, the price, billing period, included features, and applicable taxes will be shown before purchase or agreed in a separate order. Unless stated otherwise, business prices are exclusive of VAT. Invoices are issued by Netinteractive sp. z o.o. using VAT ID PL5272766291.

7. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access when reasonably necessary to address a material breach, security risk, unlawful use, non-payment, or a binding legal requirement. Where appropriate, we will give notice and an opportunity to remedy the issue.

After termination, content may be deleted subject to applicable law, agreed retention periods, operational backups, and our Privacy Policy.

8. Intellectual property

Foplink, its software, interface, branding, and documentation are owned by the Provider or its licensors. These terms grant only a limited, non-exclusive, non-transferable right to use the service while the account or authorized review access remains active.

9. Responsibility

Each party is responsible for damage caused by its breach of these terms or applicable law. To the extent permitted by law, we are not responsible for indirect loss, lost profits, loss caused by customer content or third-party websites, or circumstances outside our reasonable control. Nothing in these terms excludes liability that cannot legally be excluded.

10. Privacy

Our Privacy Policy explains how personal data is processed. Organizations using Foplink to collect feedback are responsible for their own instructions to reviewers and for identifying an appropriate legal basis for the content they submit.

11. Governing law and disputes

These terms are governed by Polish law. Disputes will be submitted to the courts having jurisdiction under applicable law. Mandatory consumer rights and jurisdiction rules, where applicable, remain unaffected.

12. Changes to these terms

We may update these terms to reflect service, security, or legal changes. The effective date will be updated, and material changes will be communicated through the service or another appropriate channel where required.
